Terms of Service

1. Who you're contracting with

MyGamePlan ("MyGamePlan", "we", "us", "our") is a service operated by Jessica Keller, an individual sole proprietor ("the Seller"). By accessing or using MyGamePlan (the "Service") you enter into a binding agreement with the Seller.

2. Acceptance of these terms

By creating a plan, voting, signing up for an account, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you don't agree, do not use the Service. If you use the Service on behalf of an organization, you confirm you have authority to bind that organization. If you are an individual user, you confirm you are of legal age in your jurisdiction to enter into this agreement.

3. The Service

MyGamePlan helps groups choose a ticketed event together using ranked-choice voting. Small groups are free. Paid one-time unlocks enable larger groups, and a Pro subscription is available for users who create many plans.

4. Your account

You must provide accurate information when creating an account and keep it up to date. You are responsible for safeguarding your credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

5. Acceptable use

You agree not to misuse the Service. In particular, you will not:

  • use the Service for any unlawful, fraudulent, or harmful purpose;
  • send spam, phishing messages, or unsolicited communications via plan invites;
  • infringe the intellectual property, privacy, or other rights of any person;
  • upload malware, attempt to interfere with the security or integrity of the Service, scrape, probe, or stress-test our systems;
  • reverse engineer, decompile, or attempt to derive source code, except as permitted by law;
  • resell, sublicense, or redistribute the Service; or
  • circumvent technical limits, paywalls, or access controls.

6. Intellectual property

The Service, including all software, design, branding, documentation, and content created by us, is owned by the Seller and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for its intended purpose within your selected plan.

7. User content

You retain ownership of the event ideas, plan titles, and other content you submit. You grant us a limited license to host, store, and process your content solely to provide the Service to you and the voters you invite.

8. Payments, billing, and refunds (Paddle as Merchant of Record)

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, applicable taxes, subscription renewals, cancellations, and refund mechanics are governed by Paddle's Buyer Terms. Our specific refund policy is set out on our Refunds page.

Pro subscriptions renew on a recurring basis (monthly or annual, depending on the plan you select) until cancelled. You can cancel at any time from your account, and your access will continue until the end of the current billing period.

9. Service availability and disclaimer of warranties

We work hard to keep MyGamePlan available, but we do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. To the fullest extent permitted by law, the Service is provided "as is" and "as available", and we disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the fullest extent permitted by law, the Seller's aggregate liability arising out of or relating to these Terms or the Service is limited to the greater of (a) the fees you paid to us in the 12 months preceding the event giving rise to the claim, or (b) USD 50. We are not liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded under applicable law (such as for fraud, death, or personal injury caused by negligence).

11. Indemnification

You agree to indemnify and hold the Seller harmless from any claims, damages, or expenses arising out of your content, your use of the Service in violation of these Terms, or your violation of any law or third-party right.

12. Suspension and termination

We may suspend or terminate your access to the Service at any time for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. You may stop using the Service at any time. On termination, your right to use the Service ends and we may delete your data after a reasonable period.

13. Changes to the Service or these Terms

We may modify the Service or these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the United States and the state in which the Seller resides, without regard to conflict-of-laws rules. Disputes will be resolved in the courts of competent jurisdiction in that state, except where mandatory consumer-protection law requires otherwise.

15. Miscellaneous

You may not assign these Terms without our prior written consent. We may assign these Terms as part of a merger, acquisition, or sale of assets. If any provision is held unenforceable, the remaining provisions remain in effect. Neither party is liable for failures caused by events beyond its reasonable control (force majeure).
